Duties of the Sheriff

Below are just a few of the Duties of the Sheriff

 

Civil Practice Law and Rules

The Sheriff may allow certain transfers of property subject to a restraining order, §5222

The Sheriff is required to collect fees, poundage and expenses with respect to all civil processes, §8011, 8013, 8014

The Sheriff may be required to enforce a civil arrest warrant, §5250

Correction Law

The Sheriff must receive and safely keep all prisoners lawfully committed to his custody, §500a, 500c

 

County Law

A Sheriff must take the required oath of office and file the necessary undertaking before assuming duties as Sheriff §402, 403

A Sheriff must act as the conservator of the peace, and serve all process §405

A Sheriff must appoint an Undersheriff with in ten days of assuming office, and is given authority to appoint deputies, clerks and special deputies as authorized by the county budget § 652

 

Criminal Procedure Law

A Sheriff must produce a defendant held where there is a superior court warrant §210.10

A Sheriff must ‘forthwith’deliver to DOCS all state ready inmates §330.20

Sheriff must produce defendants pursuant to court orders §550.10

 

Environmental Conservation Law

A Sheriff serves as the reporting agency in the event that a motorist accidentally kills a bear or deer §11-0915

A Sheriff must collect certain taxes imposed by the Environmental Conservation Law §13-0303

 

Executive Law

The Sheriff must supervise the operations of a civil defense director when conducting a drill incident to disaster assistance §29-b

A Sheriff must transmit information to NYSPIN regarding orders of protection §221-a

 

General Municipal Law

A Sheriff has the duty to take all lawful means to prevent damage by mob or riot §71

A Sheriff is required to use his personnel and equipment as directed by the Governor whenever the public interest so requires

A Sheriff is authorized to declare a state of special emergency and to call upon outside forces in an emergency §209-f(2)

 

Judiciary Law

A Sheriff is required to adjourn court in absence of the judge §8

A Sheriff is required to act as a court crier when requested by the court §406

A Sheriff is required to serve jurors with summons, when necessary §516

 

Navigation Law

The Sheriff is authorized to verify complaints and informations made under the Navigation Law §20

The Sheriff is directed to serve summons and complaints for certain violations regarding boating laws §74

 

Public Health Law

The Sheriff must enforce warrants issued by local boards of health §309

The Sheriff is required to enforce an order by the Governor to abate certain nuisances §1301

 

Public Officers Law

The Sheriff is authorized to use his judgment to appoint non-residents as deputy sheriffs in certain temporary situations §3-b

 

Public Lands Law

The Sheriff is required to enforce warrants issued by the Commissioner of General Services to remove persons from certain lands §38-a

 

Penal Law

The Sheriff is required to accept the surrender of illegal weapons §265.20

 

Real Property Actions and Proceedings Law

The Sheriff is reburied to enforce eviction warrants §749

The Sheriff is reburied to sell real property subject to court order §1073

 

Vehicle and Traffic Law

A Sheriff is authorized to affirm certain complaints §208

A Sheriff is required to serve process in some auto accident cases §253

A Sheriff serves as the reporting agency for ATV accidents §2413

 

Uniform Justice Court Act

A Sheriff must serve as the enforcement officer of justice courts, and thus is responsible for service of process and enforcement of all orders and judgments of these courts § 110
